The artist reserves the right to accept or decline a commission.

Health Conditions

The artist hereby states (and can demonstrate) that she suffers from a chronic health condition (Multiple Sclerosis). As it is not completely debilitating work can usually be done in the stated times, but as sometimes symptoms are harder, there can be delays due to those symptoms. The artist will be careful to warn their customers either on public social medias (Discord, Twitter, etc. ) or in exceptional cases, in private (DMs, Twitter, Mail).

TOS

Payment
-
If the artist accepts the commission- Payments can be done fully or in payment plan (max. 3 payments), work starts as soon as the first payment is done (if it is after the agreed start date, otherwise it starts on the said date).
Worked assets are delivered only AFTER payment is complete (in case of payment plans).

.Personal use
-
the client reserves the right to use the commission for their personal usage, this includes but not limited to print for personal display, wallpaper, posted as profile icons on websites/social medias as long as they give proper credits to the artist.

.Revisions
-
the artist will request revision approvals for at least 2 instances of the work, specifically for the sketch and coloring (pre-rendering) phase. These revisions cannot lead to backtracking already approved steps, nor increase drastically the amount of work planned for the commission. (Otherwise extra fees may apply, depending on the work to do, extra fees may amount to max 80% of the agreed price of the commission, in case of radical changes to the sketch during the colored revision phase)

.Refunds

Commissions are NON-refundable after payment unless the artist decides to cancel the commission, if the artist has not sent any update regarding the commission progress for a period longer than 14 days or if the artist is the only one at fault for missing a rush-order deadline. Only in those cases, the payment will be fully or partially refunded if the client requests it.

.Withdrawal Period
-
By accepting the following TOS you agree to receive the product as soon as it is ready, without waiting for the 14-day withdrawal period. Therefore you expressly waive your statutory right to withdraw from this purchase. In any case the rules described in the previous section (Refunds) do apply.

.Termination
-
if the client fails to respond to revisions approval from the artist for a period longer than 14 days, the commissioned work will be considered completed by both parties without need of refunds or further work. The contract hereby stated will be terminated and a new one has to be established to follow on with work (Exceptions apply depending on the situation). However, stating and demonstrating the impossibility to give feedback at the moment is possible and will be taken into consideration by the artist, the work will be frozen and restarted at the moment of the given feedback.

.Private and Commercial use

Unless negotiated otherwise, the artist reserves the right to use and publish the commission and work in progress on their social medias, streaming platforms, banners, websites and portfolio as well as retain the commercial use licenses of the commission.

PRIVATE AND COMMERCIAL USE LICENSES TYPES

Commercial use licenses transfer the rights ownerships that are initially retained by the artist.

.The owner of commercial use is still required to give proper credits to the artist while using or exposing the work.

.The owner of commercial use licences have the rights to use the commission as merchandise to sell, promote, distribute, produce and for any other commercial purposes as long as they don't involve modifying the product or impacting negatively the artist. The specific terms must be negotiated beforehand through the following options:

Commercial use license A (promotional material linked to commercial purposes: VTuber branding, online shops, Twitch, Youtube) 1.5x
-Commercial use license B (merch where the art is not the main focus: book cover, concept art, game assets) 2x
-Commercial use license C (merch where the art is the main focus: keychains, pillow cover, t-shirt design) 3x

Private commission (keep the work secret until client release and at most for 6 months) 2x.

The following is considered Copyright infringement:
Reproducing/using the copyrighted artwork commercially. [Unless stated and agreed upon with the commissioner]

Taking Credit for the creation of the artwork.
-Removing any watermarks/signatures.
-Altering the artwork without my, the artist´s, consent.

Using the sketch to commission other artists before completing the payment plan (unless previously agreed with the artist, as part of a bigger project where sketched designs are necessary for other content creation and deadlines apply. In that case, extra fees may apply, but it depends on the situation).

.NFTs
-
You are prohibited from using my work as an NFT and promoting NFTs, under any circumstances.
.
.Rush Order
-
Commissions don't have a deadline but usually will rarely exceed the stated times (in the commission info page) to finalize unless the work involved requires it or under specific circumstances.

.To get a deadline, you need a rush order.
.
.Rush orders have a deadline starting from the day when the payment has been completed.
.

SPECIFIC TERMS FOR LIVE2D MODEL RIGGING

I, the artist, will take care of revisiong the PSD files as delivered and if changes are to be applied, notify the artist or
, if direct contact with the artist is not possible, the client.

.I will reserve the right to decline a commission if it doesn't fit the possibilities i have for rigging.
.
.If the artist is not available for the requested corrections to the PSD file before rigging, extra charges will apply and will be agreed upon with the client.
However, any corrections required that are NOT stated at the moment of revision will be done free of charge.
.
.In case of Art+Rig commission bundles, a discount over separated Art and Rig commissions is already applied and calculate in the price (visible on carrd / vgen). Also Commercial Fee tier A (For social/vtuber purposes) is included in the price and has not to be paid extra.
.
.As per all the other commissions NDA agreements imply extra fees, if not agreed before the work starts, the artist reserves the right to post and publish all stages of the work on social media, and for testing purposes (for limited time) can use the vtuber model during a stream on live streaming socials (twitch, youtube, etc.)
.
.A 5% discount may be applied if you are okay with giving the artist permission to use ALL or PARTS of your vtuber model as base for tutorial contents, which will NOT be sold.
A 10% discount may be given over ART+RIG Bundle commissions to use ALL or PARTS of the model as base for paid live2d study materials, sold on ko.fi or other platforms. This can be done also outside of the bundle commissions, but the model HAS to have a commercial fee equal or superior to the TIER C described in this document.

.After delivering the commission, the artist does not make use of giving refunds under any circumstances. If the art is deemed not appropriate for streaming and other platforms, the artist could accept as a commission the review of the art.
.
.If you commission me you have automatically accepted the hereby described T.O.S, updated to the current date and the current status. New changes of the document will not apply to already agreed contracts, but will apply in case of a refresh or renewal of the commission (see. Termination section)
All versions of the TOS will be kept and archived in case it is necessary to read them again at the agreed status..
.In case of Vgen commissions, the confirmation of accepting the TOS will be handled by the platform.
In case of other commissions, the invoice payment counts as proof of acceptance of the TOS and will be used as such in case of verification.
